Terms and Conditions

These Terms and Conditions govern the purchase of products through the Santa & Cole website (www.santacole.com) and apply to all orders placed on the platform. Please read them carefully before placing an order. By completing a purchase, you confirm that you have read, understood, and accepted these terms in full.

To place an order on our website, you must be at least 18 years of age and have the legal capacity to enter into binding contracts. By placing an order, you confirm that both conditions are met.

To place an order, you must provide a valid billing address and payment information.

Once you have completed your order and accepted these Terms and Conditions, Santa & Cole will send a confirmation email to the address you provided. This email constitutes acknowledgment of your order but does not yet constitute acceptance by Santa & Cole. We reserve the right to cancel any order that we reasonably believe to be false, fraudulent, or in violation of these terms, and to notify the relevant authorities if appropriate.

If the confirmation email contains any errors or does not reflect your intended order, please contact us immediately at webfriends@santacole.com.

Prices are displayed as an invitation to purchase and are not binding on Santa & Cole until the order has been confirmed. In the event of a pricing error, we will notify you and cancel the order.

Purchases delivered within the European Union are subject to VAT or the applicable equivalent tax. Purchases delivered to non-EU territories, including the Canary Islands, Ceuta, and Melilla, are exempt from VAT; local taxes applicable in those territories may apply.

Santa & Cole reserves the right to modify prices, promotions, and commercial conditions at any time without prior notice. The price applicable to your order is the one displayed at the time of purchase. Please review the final price carefully before completing payment.

For deliveries outside the eurozone, please note that the final amount charged in your local currency may vary slightly from the reference price due to exchange rate fluctuations at the time of the transaction.

Import duties and customs fees, where applicable, are the responsibility of the purchaser.

We accept payment via Visa, PayPal, Klarna, and Adyen. You may choose the method that best suits you at checkout.

All transactions are processed through secure payment gateways in compliance with PCI DSS international security standards. Your card details are transmitted using SSL (Secure Sockets Layer) encryption and are not accessible to third parties at any point during the process.

If you identify an unauthorized or fraudulent charge on the payment method used for a Santa & Cole purchase, please notify us as soon as possible at hola@santacole.com so that we can take the appropriate steps.

If you notice an error in your personal data during registration or checkout, you can correct it at any time in the “My Account” section or by contacting us at webfriends@santacole.com.

Our platform displays confirmation screens at each stage of the purchase process and will not allow you to proceed if required fields are incomplete or incorrectly filled. Before payment, you can review and modify all items in your cart. If you notice an error after completing payment, please contact us immediately.

Santa & Cole ships to Spain and a selection of international destinations. Users accessing the website from outside Spain are solely responsible for ensuring compliance with their local laws and import regulations.

All orders are subject to product availability. If a product is out of stock or cannot be supplied, we will notify you and refund any amount paid in full.

Delivery times are calculated from the date the order leaves our warehouse and apply to products in stock. Estimated delivery times are as follows:

For orders that include larger products, delivery times may be longer. If you have any questions, please contact us at webfriends@santacole.com before placing your order.

Shipping costs are calculated automatically during checkout based on the destination and the products selected. Santa & Cole will select the most appropriate carrier for each shipment.
If the shipping cost changes after your order is confirmed, we will notify you by email and you may cancel your order at no cost.

Santa & Cole does not ship on public holidays, Saturdays, or Sundays. Delivery times may also be affected by exceptional circumstances at the carrier, difficulties in accessing the delivery address, or force majeure events. Delays in delivery beyond the estimated times do not entitle the purchaser to claim compensation.

If we are unable to meet the agreed delivery date, we will contact you and offer the option to set a new delivery date or cancel your order with a full refund.

Delivery requires someone to be present at the shipping address during business hours; a contact phone number is required to coordinate delivery.

Delivery is considered complete at the moment you, or a third party designated by you, takes physical possession of the products, as evidenced by signature of the delivery receipt.

If delivery cannot be completed, your order will be returned to our warehouse and we will contact you to arrange an alternative delivery. If the order remains undelivered for 30 days for reasons not attributable to Santa & Cole, we will treat the contract as terminated and issue a full refund of the amount paid, including standard delivery charges. Any costs arising from the return shipment in this scenario may be deducted.

In accordance with Spanish Royal Decree 1/2007 of November 16, 2007 (revised General Law for the Defense of Consumers and Users) and applicable European consumer protection legislation, you have the right to withdraw from your purchase within 14 calendar days of receiving the products, without providing any reason.

To exercise your right of withdrawal, you must notify Santa & Cole within this period by any legally accepted means of communication.

Returns are accepted under the following conditions: the product must not have been used beyond what is necessary to assess its nature and characteristics, it must be in the same condition in which it was delivered, and it must be returned in its original packaging, together with all instructions and accompanying documentation.

Customized, made-to-order products cannot be returned or cancelled under any circumstances.

Exchanges are not accepted. If you wish to replace a product, you must process a return (if applicable) and place a new order.

Return shipping. For non-defective products, return shipping costs are borne by the customer. Santa & Cole provides a printable return label. No restocking fees apply.

Refunds will be issued using the same payment method used for the original purchase, within 30 days of receiving and inspecting the returned item. No refund will be processed until the returned product and its packaging have been verified.

During specific periods (such as holidays), Santa & Cole may offer extended return windows, which will be communicated on the website.

Shipping damage. Visible damage or discrepancies caused during transport must be reported to Santa & Cole within 7 calendar days of receipt, by email to webfriends@santacole.com. This deadline applies specifically to damage attributable to the carrier and does not affect your rights under the legal guarantee described below.

Faulty products. If a product is defective, Santa & Cole will replace it with the same item once the defective product has been received. In this case, Santa & Cole covers the cost of both the return and the new shipment. If you prefer to exchange the faulty product for a different item, return and delivery costs will be your responsibility.

Incorrect products. If you receive a product that does not match your order, Santa & Cole will cover the cost of collecting the incorrect item and delivering the correct one.

All refunds are issued in EUR. If your original payment was made in a different currency, the refunded amount will be converted at the exchange rate applicable at the time of the refund.

Santa & Cole’s products are covered by the legal guarantee of conformity for a period of two years from the date of delivery, in accordance with Spanish Royal Decree 1/2007 of November 16, 2007 and Directive (EU) 2019/771, without prejudice to any more favorable provisions applicable in the buyer’s country of residence within the European Union.

Products are considered to conform to the contract when they match the description and characteristics presented on our website, are fit for the purposes for which such products are ordinarily used, and offer the quality and performance that would reasonably be expected of them.

If a lack of conformity becomes apparent within the first twelve months of delivery, it is presumed to have existed at the time of delivery. In that case, it is Santa & Cole’s responsibility to demonstrate otherwise, not the buyer’s responsibility to prove the defect existed at the time of purchase.

If a product does not conform to these conditions, you may request repair, replacement, a price reduction, or a full refund, in accordance with the terms established by applicable law.

The full amount paid for any product returned due to a confirmed defect will be refunded, including the original delivery cost and any reasonable return shipping costs you may have incurred. The refund will be made using the same payment method as the original purchase.

These Terms and Conditions are governed by Spanish law. Any disputes arising from or related to the purchase of products through our website shall be submitted to the courts of Barcelona, without prejudice to the mandatory consumer protection rights applicable in the buyer’s country of residence within the European Union.
